Commerce Commission v Yoghurt Story New Zealand Limited and Frozen Yoghurt Limited [2016] (NZ)
In 2016, the District Court held that Yoghurt Story New Zealand Limited and Frozen Yoghurt Limited breached Section 10 of the Fair Trading Act 1986, in that they misled the public as to the nature and characteristic of their product. The companies had made two misleading representations, first that the product sold in "Yoghurt Story" stores was Yogurt when it was not and secondly, that the product sold in "Yoghurt Story" stores had certain health benefits when it did not.
