ACCC v Cadbury Schweppes [2004]
The Federal Court found that the false representations made by Cadbury Schweppes, in the labelling, packaging and pictures of Cottees cordial products, were misleading or deceptive and hence contravened the Trade Practices Act 1974 (now Australian Consumer law). The pictures on the product depicted real fruit and represented to potential consumers that real fruits were contained in the cordial when this was not the case.
