Federal Court issues judgment on use of natural claim in trade mark case

On 31 August 2017 the Federal Court of Australia delivered its judgment in an action that was brought against Aldi for trade mark infringement, in relation to its home brand products. One of the most interesting aspects of the case was the judge’s interpretation of a natural claim. This article discusses the Court decision and implications.
