GM Presence and Legal Issues about Adventitious Presence

The debate continues between those who oppose genetic engineering of food plants and those who see GM food as no different from any other breeding improvement or biotechnical innovation. Irrespective of one’s view, the promotion by food retailers and suppliers of GM-free status for some foods (whether “organic” or not) means that there are legal responsibilities and liabilities when such a claim requires appropriate substantiation. This article explores the concept of adventitious presence and its legal implications.
